How the Law Views Credit Card Fraud
Under NRS 205.690 (5) (a) (b), it is against the law to use the credit
card information of another person without his or her permission. Simply
possessing a physical credit card is not enough to demonstrate that fraud
has taken place. Many times, using the credit card number imprinted without
the cardholder’s permission can constitute credit card fraud.
Credit card fraud is a class D felony, which may entail the following penalties:
- 1-4 years in state prison
- $5, 000 or more in fines
- Restitution to victims
As Las Vegas criminal defense attorneys, we can fight any accusations of
credit card fraud on your behalf. Have you been accused? Remember that
in these types of cases, the prosecution must prove that you intended
to commit fraud. Another possible defense is to investigate whether or
not the police acted unlawfully, such as performing a search and seizure
without reasonable cause. Or, the police mistook you for someone else,
and you were identified incorrectly. We can take a closer look at the
circumstances of your case and build a strong defense for you.
