Under NRS 453.336, it is against the law to knowingly or intentionally possessing a Schedule I controlled substance.

According to NRS 453.337, it is illegal for a person to possess methamphetamine with intent to sell. While possession can be straightforward to determine, an individual can be arrested for possession with the intent to sell if they have a large quantity of drugs and cash, weapons, scales or baggies.

Penalties for possession with intent to sell include:

  • First Offense – Category D Felony
    • 1-4 years in prison
    • Fines up to $5,000
  • Second Offense – Category C Felony
    • 1-5 years in prison
    • Fines up to $10,000
  • Third or Subsequent Offense – Category B Felony
    • 3-15 years
    • Fines up to $20,000

Sale of Methamphetamine

Under NRS 453.321, it is illegal for a person to sell, import, transport, barter, supply, prescribe, exchange, administer, dispense or give away a controlled or counterfeit substance. To prove a sale occurred, there needs to be a transaction of money for drugs.

Penalties for selling methamphetamine include:

  • First Offense – Category B Felony
    • 1-6 years in prison
    • Fines up to $20,000
  • Second Offense – Category B Felony
    • 2-10 years in prison
    • Fines up to $20,000
  • Third or Subsequent Offense – Category B Felony
    • 3-15 years in prison
    • Fines up to $20,000

Methamphetamine Trafficking

NRS 453.3385 states that individuals who knowingly or intentionally sells, manufactures, delivers or brings into this state or who is knowingly or intentionally in actual or constructive possession of methamphetamine or any other Schedule I substance, can be convicted of trafficking.

Penalties for trafficking methamphetamine include:

  • Between 4 and 14 Grams – Category B Felony
    • 1-6 years in prison
    • Fines up to $50,000
  • Between 14 and 28 Grams – Category B Felony
    • 2-15 years in prison
    • Fines up to $100,00
  • 28 Grams or More – Category A Felony
    • 25 years to life in prison
    • Fines up to $500,000
